Paragraph 1:- ‘In this case, the Domain Name comprises the combination of a geographical location….which is generic.’ Next paragraph 2:- ‘In the present case, it is the view of the Expert that the Domain Name is distinctive and that it is not wholly descriptive or generic. ‘ errr...generic??? Lee |

That to me is saying Sussex is a geographical location - period - and that the word skips is generic. Which is true. The expert has found that putting a geograpical location and a generic word together is not wholly generic or descriptive - he has not said it is a generic term and then changed his mind further down. I disagree with the expert as UKJobs or ManchesterFood would not be generic/descriptive... however to be fair to him what you claim he said he didnt really say Last edited by rob; 01-12-2006 at 08:57:01 PM. I have bolded the bit that went awol somewhere in your clipboard - a vital part of the sentance as it changes the entire meaning! Your sentance says geographic locations are generic, and the expert says the word 'skip' is generic. | |

Actually the expert was saying the phrase was generic i.e. suzzex skips BUT in his opinion it became ungeneric because of the complainants good will in the name sussex skips All I was saying was why say it was generic when it wasnt i.e it confuses the mind Lee |
