Well the friday before xmas ive recieved a letter from from a solicitor basically telling me to hand the **.org.uk over or face DRS Its funny because they have admitted they don't have a TM for the 2 word .org.uk but will defend its intellectual property rights. The domain in question i have a forum on there and they have a completly different site. Is there anyone on here willing to take a look and see if i have a leg to stand on or is it worth fighting for. thanks in advance. ill pm domain if anyone is interested. thanks paul |

As long as the two words are not something blatant like "orange phones" etc, and your forum and any ads on it are completely different to the subject of "their" property rights then no I don't think they can DRS you. But as always, get professional advice first before you decide to fight. I mean is any .org.uk worth more than £750 anyway?

Grant, when you say DRS will cost Paul zero pence...... I had a similar situation whereby I was told they would try to recover any costs or solicitors fees incurred, so I would potentially face £750+ vat for drs plus solicitor costs. Is that easy for them to do? I ended up letting them have the domain for £400 as I believed they would win any drs. I told them £400 is less than half what it would cost them to take it and they agreed. They must be able to easily recover the fees otherwise what's to stop people regging tm domains, and offering them to the company, with a view to settling for whatever you can get. Worst case giving it up for free? |

Not all legal fees are recoverable.... Again, another one I would openly tell to sod off.. |
