Thumbs down Bounce Appeal Being Used In 'Expert' Decisions

...You would have thought given the history of the Bounce case Nominet would of instructed or directed their 'Experts' NOT to refer to it - Ah well, so much for common sense.

Interesting argument

This is an interesting argument:-

At time of registration it had abusive intent

Later the registrant gained an understanding of the law and decided to use the name on the basis of a legitimate business.

The contract is only 2 years, therefore what is important is the intent at contraction renewal date not registration.

Contradiction?

Of course, like BOUNCE, HOT WHEELS has a potential generic meaning. It is a simple combination of two generic words: - the noun “wheels” and the adjective “hot”. The mere combination of these words does not seem particularly distinctive. Indeed, it does not require too much imagination to envisage the words being used in colloquial conversation to describe desirable or popular automotive products.

Unless I've missed it somewhere in the text, Mr Harris strangely forgets to mention that he was one of the Appeal Panelists in Bounce... He seems to be justifying his own reasoning in this case - without making clear his connection to both cases.
