Have received a solicitors letter yesterday (first one) telling me to hand over a financial tm typo to them. The name was registered early 2006 - I got a c&d email from the company in April 2006. I promptly put it in my deleted folder at a parking service - upon reloading the page i was getting a blank page with an error message as expected. I thought I would let it expire and that was the end of it.

upon receiving the letter, I typed in the domain and it was once more resolving to a parking page. I contacted the parking company about it and was informed that I had not changed the nameservers so it resolves to one of their standard landing pages even though it was showing an error page last year???. I have now changed nameservers over so its loading to a blank page. another thread for later perhaps??

I have also been informed by the solicitors that I am in breach of Nominet contract as I have requested to opt out of the whois. The letter was sent to occupier at my address.
They say that to prevent further legal action, including an application to Nominet for transfer of the Domain being taken against me I should hand it over in 7 days.

What should I do?
1) Dump it and let them register it hopefully.
2) Get the transfer forms from nominet and hand it over to them.

Sounds like scare tactics.

It costs them money to take legal action and take action through Nominet.

They are hoping you will just hand it over to them.

Depends what domain it is and who the company are really.

By the sounds of it you don't have a leg to stand on. Why risk further legal action by deleting it? Send them the forms and think yourself lucky - in theory they could have hit you for damages + costs from the outset.

Could be either scare tactics or they are deadly serious (obviously!!)

Either way weigh up whether you :

a. Want the grief
b. Want to spend time justifying keeping it
c. Want to spend time negotiating a fee
d. Are prepared for losing the domain with costs and reputation (remember everyone knows everyone these days so running in to lawyers / companies / individuals etc is not that uncommon - trust me )

Personally, supposing I really really wanted to keep the domain (cos it makes me £200pm+ for doing nothing) I woudl send them a reply saying you have received theyir complaint and are dealing with it through your lawyers. Buys time... then wait and wait...

Trust me if they are serious they will contact you within 21 days or so when they haven't heard!

Of course if you just want shot - there's no harm in sending a nice email and asking for a small amount for a goo dnight down the pub. I've done that route before on 3 separate occassions and each time walked with away with between £200 and £300 - everyone is happy for min fuss.

You could surrender it.........and keep them guessing when another entity picks up the domain as a new registration.
