Possible solution: but unsure of the downsides.

To put a statement on my website that it has no connection to nuts magazine.

Has anyone come across this before and if I agree to this what are the possible downsides?

Future sales value of domain?
Branding of physical goods etc?
Future trademark applications?

The downside in my mind is that, by stating that there is no connection to Nuts magazine, you are effectively admitting that there *could* be confusion.

This could be used against you in the future - if you later argue that there's no prospect of confusion then the fact that there's a disclaimer suggests that you knew that there was a prospect of confusion because you put the disclaimer on.

Just my 2 cents

I play a lot of poker, both onliner and live.

I have actually thought about sourcing the domain myself but never got around to it

There is no way IMHO that these guys can lay any claim to that name.
It has been used in poker since the days of of the gun slinging westerns.

It derives from the times when players would be so sure about their hands that they would bet their horse and cart on it.
They would then put the wheel nuts in the pot to make sure they werent going anywhere when the cards were turned over. ie Ive got "The Nuts".

You could easily get this confirmed and backed up by the major poker magazines and poker sites.

Good luck with it, Im sure you'll be fine.
