Just launched a DRS aginst Asda.co.uk I'm hoping to highlight a pioint about how stupid the New DRS is with regards needing a reply from ASDA. Every weeks I will DRS someone new until someone realises what a pee take the whole system could become. This will cause ASDA more to reply than it cost me to file, maybe some common sense will dawn on someone at nominet before people start doing this with the serious aim of getting a name from a medium size / small company who's domain admin isn't as good as the big ones. Maybe everyone who thinks this system is barmy should launch a DRS against someone.

Good luck! Sure you won't be the first or last to chance your arm! The new system IMO is a step forward, but misses the fundamental point that anyone can initiate a DRS without proper justification. There's no pre-vetting stage other than to count the number of words and make sure all boxes are filled in. Evidence is only checked at the post-mediation stage. It seems a real waste of Nominet time. DRS applications should be treated with the same stringency as a visa application. Maybe some of the big slush-fund that Nominet has now could go towards a pre-DRS panel which would sit monthly to examine new DRS's and only those that fit the criteria of just cause would be allowed to pass through to the DRS stages. |

Too good to miss mate, the first stage of this drs was free, and if they don't reply then bingo! Obviosuly Asda.co.uk won't be that easy and no chance at all of me getting it, nor would I want the hassle but there will be someone a little down the food chain and with a good domain that will be caught out by this. well their is that but can you sue someone for filling a DRS?, If so that would be a huge precedent and maybe a warning to others not to file silly DRS's. Which law of averages would suggest someone will do to me over my 900 names, and if the postman loses a letter I lose my domain. My aim is in no way to get this name, it's to highlight what a pain in the backside this new system is going to be if people can file endless DRS's for free and their is no downside for them. Maybe Nomient will place a ban on me for doing it, either way whatever measures they take against me will prevent someone taking this up as a serious hobby and making a fortune from it. If people thought second hand domainers were scum of the earth, wait till this becomes a full time job.

What would be a 'better' way of proving the point to avoid any third party issues would be one domainer to DRS another with full knowledge. If two domainers with 500 odd names each DRS'ed each other on every name then the Nominet DRS department would quickly see that 'free' DRS's do waste alot of time... |

Just a quick one to tag onto the end of this: I was told by Nominet at the last DRS Consultation Event that they would be emailing all registrants to inform them of this contractual change, but as far as I can see this has not happened. I shall be asking Nominet why and posting the reply here. I'm of the view that the new DRS policy/proceedure does not conform with the consultation responses, in particular the issue of a an 'upfront fee' to start a DRS as I believe the majority opted for something around the £100 mark, which I'm guessing would have put pay to the supposedly large number of vexatious complaints Nominet will now recieve. Maybe someone will argue the processes Nominet have followed in implementing these new rules are not correct and file a Judicial Review application against Nominet in the High Court. That person of course would only have 3 months to do so from the date of implementation - i.e. 'the clock is now ticking'. I'm am of course not advocation such action, just pointing out the posibilities. Regards, Sneezy. |
