What was the major problem that saw a DRS win for Apple with itunes? It's about to happen all over again but just in case I catch it - doubtful - what shouldn't you do if you get it?

So using it for something different should see them kept at bay then. I should have booked it on dropcatcher when I saw it, just couldn't be bothered with any possible hassle, it was only booked in the last day.

Yes, if you clearly use it for something entirely different then what grounds could they have for taking it from you? There are 45 general classes of goods and services for trademarks. That leaves a lot of scope. It will of course reduce ppc earnings and therefore lessen the attractiveness of the domain to you in the first place. You could take the risk but then you might lose it on a DRS or other legal action, expensive if costs are awarded against you by a court. Not worth it in my view.

I've got several domains that are trademarks but I never set keywords for those marks. That would be suicide.
