Anyone willing to start dissecting why this one went the way it did? Decisions Taken from the Decision: * Complainant claimed to have written to Respondent at address obtained from WHOIS but had their letter returned marked "gone away". * Respondent had been using the WHOIS address opt-out which is only for use by Individuals who are non-trading. Nominet removed this but Expert mentioned this in his summing ups. * Respondent had been publishing links, from a parking company, via the domain name, for clothing and fashion items. These items relate directly to the trade mark of the Complainant. * Respondent didn't respond (reminds me of bounce.co.uk) |

I read it earlier this evening - it's an extraordinarily long decision (16 pages) given that there was no response. Maybe a case of the expert liking the sound of his own voice, or maybe a case of Nominet covering its arse. Oh no, it can't be the latter because the DRS is independent of Nominet [comment removed just in case
