can they take my domain

Hi all,

We have held a domain since 1996 and have been approached by a company to purchase it , we replied back to organizations indicating we would be reluctant to sell on the basics we could negotiate a price. Then the replay back saying that wanted to take us to court over the domain that we have been using it as bad faith

The domain has been parked for duration
Had two website Non related
Not even index in Google

The site had non of the follow
No Trade Marks infringements
No Trade Names
No Links Point back to their site

The company has the domain similar to the company house registered name

Could anybody give me any tips on how I should reply or should I even reply back to these crooks or should I ignore the template threat of court action , or just wait to see if file a complaint with Nominet.

Depends what it is mate, if you want to PMrivate message me the name I'll give you better advice.

If you don't want to PM it, no problem.

What I would do is make sure your contact details are spot on with Nominet and wait for contact and details of why they think they should obtain the name.

Also, the Companies House name confers no intellectual property rights to a domain name, only the UK Trademark could possibly do that.

Call a lawyer who specialises in this. Nobody on here can advise you without any specific details. What you have provided is not specific enough.

Try Adam Taylor of Adlex or Briffa. An opinion shouldn't cost much.

You should be fine on that, I don't think you will have problems. Seems pretty generic to me and there are a number of companies selling in a certain sector all with the same name.

So if they were serious, they'd probably sue each other for trademark infringement first.

Just don't do anything silly and you'll keep the name without much risk. Would be worth getting something on the site, even if it's just a login screen.

even if the name was a TM as long as its not a related business to do with the TM it shouldnt be a problem but i still believe wipo,udrp and nominet are rife with corruption.
