Lets say I have registered a generic 3 word phrase .co.uk and a Company based in UK also are using the .com already. They have, I see today, very recently,also applied for a trade mark of that generic 3 word phrase BUT with the addition of their full ,and rather long, company name say 3 word phrase + Fred Bloggs Barrows Plc. The TM is only valid on the whole text NOT just the 3 word phrase. Do they have a valid DRS claim against me ?. What if I approach them and ask to buy or vice versa ,do I say "sorry I cannot talk because otherwise the DRS will go against me " ?. DG |
