So if the complainant fails to take the case past mediation because in effect they see my argument stronger, the complainant can in effect not follow through with that line of argument and attempt to do so again by starting the process for a second time, but this time with full knowledge of the defence?

Yes. However this might happen if they do that (see pages 6 and 7).
