You do not say if you have paid for the domain? or any of the terms of the contract, It depends greatly on the conditions of the contract and if your solicitor has told you it is straight forward without seeing the contract terms etc then I would be extremely surprised, No one can say it would be straightforward without knowing what the terms are ?

E.g. The seller could quite simply say if you had not paid over any monies that you are in breach of terms and are know trying to get the domain on the cheap….

I would get a set of the terms and conditions first, then contact the seller, then the auction (if possible find out the sellers ability to pay and weather they are a limited company etc very little business sense in taking a business/individual to court and winning only to find they do not have a penny to pay you or your fees) then lastly contact a Solicitor The courts are not there to get you money items etc only to ensure that no laws are broken ????

Even if the person is named, it's still 2 years on, and if they've bought and sold a load of names through this forum and not messed people about I can't imagine many people would hold this against them.

Trouble is all they have to say is that "I didn't put it on sedo, don't know what you are talking about", then what would you do? Can't sieze his computer for forensics and things to see if it was him that did it. Then if it is his computer, he then says well the mrs did it?

The advice is harsh but save your money mate.... contact them and say you are about to name and shame unless they complete, at which point they will say why they didn't complete and go from there.

Ask one of the admins or mods before you post it though, always best to get that side sorted first.

Yes I did pay for the domain name (but received refund from Sedo later) and there is no date to say for how long the contract is valid for. Yes I know 2 years may seem long time but it does not mean that the contract is not valid. To prove all this It will not be hard, Sedo keeps longs of everything. Also he already has admitted that he has submitted domain to the auction.

I did contact the seller ( as I mentioned - he is member of this forum and provides services to domainers so it wasn’t hard to find him) but he doesn’t want to hear about this. He told me that domain has been sold prior to the time of Sedo auction. Domain was’ t his property so the contract is invalid.

That makes sense but, he refusing to provide any evidence to confirm that. Also, the domain is still registered to HIS name. If domain isn’t his property, very unlikely it would be on this name after 2 years. Its parked to Name drive, when I asked -“ is it parked to your account” he declined to answer. He is not answering simple questions and becoming frustrated with me, saying that I am wasting his time. To me that is clear sign that he is not telling the truth. Now I bet you all want to know who I am talking about.

Yes I do like the domain and I want it. Also hate the fact the way I am being treated. If I was push over, I would ‘t be where I am at the moment.

I will ask Admin's permission to name shame him on this forum . If all fails, I will start legal action. In 10 years of domain business I am well used to legal action. I will make sure to recover what belongs to me and will make him pay for it.

Could it be possible that he sold the name, and re-purchased it at a later date. It's not unheard of - I can think of at least one name that's passed around a lot of domainers and has been offered back to the original seller at a loss...

After two years, I am not sure whether you'll have much hope. Any judge will ask you why you waited so long! Good luck to you if you do try...
