First .eu ADR I've seen for an Acorn Member - Ouch!

Looks like Michael Toth is going to loose emirates.eu, which must be a bugger as I'm guessing it was purchased on the secondary market:

ADR.eu

...The question now is; will this now open the door to a DRS for the .co.uk and .ltd.uk which Michael also owns?

Anyway sounds expensive, especially with Eric Ramage's fees (Nominet PAB Chair) - Ouch!

Regards,

Sneezy.

A shame as it states that he has the ltd.uk which would suggest he has a company called 'emirates ltd' in the uk, I havent read it all, was that included in the arguement?

Sorry to see that happen.

You cant beat big money business when comes to brands looks like they went for the weak option. get the .eu first that then show legal presedence for going for the .uk.

Bet before the dust settles they will lay claim to .co.uk
its discusting that other business can come along and basically steal the business that a person has build up.

wish michael good luck if the do come after the .co.uk

I'm a little surprised at this decision. I thought that the only country name that was ever construed to be a TM was 'The Vatican'. The .org is monetised so I supose they'll be going after that next.

Not a reasonable decision overall IMHO.

I sometimes wonder whether ADR/DRS/UDRP processes are little more that self serving functions for the registries. When dangled as a carrot for a cheaper decision mechanism, they might well be preventing significant 'legal precedent' decisions from being made.

On another point, I liked the "A&B&C&D&E...." trademark approach though, very clever!

So whatever the rights or wrongs of the decision, they clearly take their branding seriously.

Looks like someone in their brand protection department will have had a roasting over this one. Where were they in the .eu sunrise period?

vitalir is on a distinguished road

I wonder what's the point in simply revoking the domain? As the next owner would get an automatic lawsuit against him, wouldn't he?

I'm definitely not being a racist here, but I know when I see a victim of thieving Arabs! (gwon, tell me the Emirates is populated by Swedes).

I notice that the asking price for makhtoum .com has dropped from $8.5k to $3.5k recently. Hmm ...
