Just recieved this email about a domain name they are interested in. They offered me £25 and when i declined it they replied with this: Sorry not to be an authority but you do realise that you would be in violation of nominets abusive registration policy http://www.nominet.org.uk/disputes/d...veregistration A. for the purposes of selling, renting or otherwise transferring the Domain Name to the Complainant or to a competitor of the Complainant, for valuable consideration in excess of the Respondent’s documented out-of-pocket costs directly associated with acquiring or using the Domain Name; The above is from paragraph 3 of the policy that the site refers to. I’m not going to open a dispute as I don’t have the time nor am I like that. I only know all this due to having to help a client through it all. It does bother me when domain names have been brought for the purpose of selling on for a profit though. This domain name is for a personal project. I do have other ideas i can use as names but i like this one the most. I did offer £25 not £20. £10 is to cover the 2 years hosting you would have just paid out for and the £15 is more than enough to cover the cost of transferring the registered name over to me (nominets fee for this is £10 plus vat). pm me and ill tell you the domain but some people |

And they know what you paid? Always amazes me that people assume reg fee. I wouldn't respond at all. |

First up that paragraph as best I recall relates to blatant trademarks like registering "nike" and trying to sell it to "nike", where nike would easily prove you was fully aware of their brand and intended on selling to them at a huge cost. If its a generic or the buyer isn't on the first page of google already (who looks deeper or elsewhere), then no case at all If you didn't reg the domain manually it was a catch for example, send them a factoring for your own tag, nom reg, coding, reg fee, research costs, ets. Even if it was reg fee, explain the process of checking the exact tool, researching affiliates, looking into advertising competitiveness, make some more stuff, waste some more time, and estimate how long it would take you to find said reg fee name now double or triple that. Now as a 'Internet Presence Consultant', your flat rate is £250 then £150+Vat per hour after that So domain took 90 minutes to locate, I make that Reg Fee, Transfer Fee, £250 + £75+Vat + £37.50 (15 minutes to handle transfer).

I would never even attempt a rational dialogue with a fool like that since reason won't get you anywhere, but the effort will likely aggravate them still further... If it's a generic, file their email and ignore it, but be prepared for the outside chance that they decide to do something through the dispute process. If it's a blatant TM (I doubt it is in this case, but in general I mean), then hand it over meekly (again without getting into a slanging match) - it's a fair cop. Either way, attempting to extract "real" value from the domain through some artificial formula is probably not going to fly. They're so high up on their high horse (from the sound of the email) that they're not going to pay it anyway.

Here is the one of the best that I have received....... Whom it may concern Domain name: "********.co.uk" To keep it short, I am interested in the domain name ********.co.uk because it is where I live and the community wish to increase their online presence. Although our website would include some commercial aspects we cannot afford to pay for this domain. However I cannot imagine that any profitable traffic is directed from this address, so it would be in your interest to transfer it to us. What a retard !! |
