I am not a lawyer, but my layman's understanding is that...

#1. Registered means you have paid the Trademark Office to have your trademark registered for a particular class of product or service (eg, Apple for computer equipment).

#2. Unregistered means you've been using the trademark w/o registering it.

Write back politely and ask them to provide details of the extent of their client's registered and unregistered interests in the term, together with the dates they registered any of those rights.

As an example, are any other companies using the "Bigger Packs" keywords in their advertising? Or when hearing the words would a layman automatically associate them with the brand?

It's Interesting though that they haven't got the Mark for "Bigger Packs" though.

Not one for rolling over, but also not one to be a git either as I would really like this company to have it. Just not as their right to it.
The trade mark they do have preceded by their brand name will be the one they are referring to as unregistered.

From the sounds of things they may also have rights to "Bigger Packs" without their brand name preceding it (which is what they will probably be referring to as being unregistered rights).

If you want to PM me the actual domain I'll let you know my thoughts.
