Obtaining a court order?

Does anyone have any knowledge and experience about how to obtain an initial court order preventing either 1. Nominet acting on receipt of a transfer form and authoring the transfer of the domain name on their register or 2. the present registrant from selling a domain name to another party?

Which court, which form, the process? Any info gratefully received.

I should think if you start proceedings and advise nominet that would put a halt to any transfers.

It's not really clear what's going on, but I think that if you start a DRS procedure, that would freeze everything for a while. Just be careful. If your actions are later viewed as malicious, you could be in trouble.

I think your best bet is to phone a decent IP lawyer and get a "free initial consultation" about what you're trying to do. In the very least they'll answer your questions above and tell you how much it's going to cost - but they may also be able to tell you an alternative way of achieving the same outcome.

...As far as I understand it, you'll not even get off the starting blocks with an Injunction if one of the first two conditions aren't met - i.e. either 'by application in pending proceedings' or 'under statutory provision'.
