Now, about 6 months ago there were news items which suggested that the ICANN rules were about to get even tighter to work in favour of the TM holder, and there was no easy way to stop it, but this post popped up the RSS feed today: jiplp: Domain names: a UDRP epiphany There's a whole big heap of legalese in that article, but (the way that I read it) the big point in there is that the "high mukamuk considerer" of TM disputes has decided that the procedure has been misinterpreted for some time, and is starting to lean towards the respondent rather more than in previous cases. Whatever, I still think it is better to avoid the situation, and I still think it is worth asking for money if you inadvertently reg a domain in good faith, rather than handing it over. |
