What were your losses/damages then?

There is major incompetence and fraud at this company.
I think that there should be a criminal case but it's all about time and money.

Even if you have business with 1and1 and are happy consider moving your domains and hosting elsewhere. The hassle you have in transfering is nothing like the hassle you'll go through when they start detagging names, or even charging you hundreds for services/domains that are no longer registered with them - which is what happened to me.

I concur with devolution about them being criminals and this being fraud. I spoke to a bunch of people at 1and1 about being charged for services that I'd long ago cancelled (including domains which had been transfered out) and yet I kept being charged until I cancelled my credit card and then they started sending me bills!

This is fraud when I give them forewarning about this issue and they continue to let it happen. Not just to me (and Devolution) but so many other people... you may be next.

I think you might find Nominet very helpful and sympathetic in situations like this. I seem to remember that the list is quite valuable. Why don't you talk to Nominet and see if you can't work towards sorting this out perhaps? Shouldn't be that difficult if they are detagged? Just ask Nominet to release them to someone else and then have them renewed

Azooza - my problems are all sorted now.

But Nominet couldn't get involved with 1and1 charging me after the names were on a different tag - my only options were the registrar and the bank.

One of the problems (which I explained to 1and1's tech/transfer department) was that they have a tag database. If you are transfering your domains (using 1and1's cancel.1and1.co.uk site) to either a newly registered tag (or a smal er registrar) then they don't recognize it. So they won't let you do it. Even if you call them, they really didn't have the brain power and either didn't believe me that the tag existed ("computer says no!") or they had no idea how to solve it.

I ended up transfering the names through Nominet directly but the names were still showing in the 1and1 CP and so of course 1and1 kept charging me, even though I called many, many times and emailed to tell them to stop charging me.

I think that Nominet should have an easy complaints department who can investigate things like this, but they basically turned me away and I asked if I could write to them (Nominet) to complain about 1and1, they said I can if I wanted to - didn't make me think it would do any good.

I have contacted the Office of Fair Trading - and I think finally I might be able to get someone to do something about this... (Fingers, hands, legs, arms, toes, nosehairs crossed )....
