Seems like a common sense rulling in my opinion, I don't think there is any confusion over the two companies or what they do.

The Beatles used the "sliced apple" on B sides.

This reminds me of something that Hank B Marvin once said:
"Make sure you write the B side for your hit singles. Even if nobody listens to it, you get the same royalties as the writer of the hit song",
