    I see what your saying but it can be very expensive to argue your case.

    i'm trying to think why you would post that reply in a sales thread !

    i'm not asking your opinion on the legalities of the situation and MY comments are fit for the purpose to stop the whingers and proclaimers who post their armchair legal observations !

    its a sales thread and to be truthful you knew that when you posted in it, when want an opinion i'll run it up the flag in the appraisals section.......maybe you should shoot over there to see if anyone's interested in what you've got to say.

    OK, I think it's a cracking domain name and would certainly be interested at the BIN price, as I think alot of others would, however, I thought it would be sensible to enquire about any trademark infringements and chose to do it in a diplomatic fashion, giving you the option to tell me to remove my comments if you felt they offended the spirit of the thread. You chose to pick a fight instead, that's your prerogative. Now in view of the potential trademark issues I'm out.

    you chose to jump in on a sales thread, There was nothing Diplomatic about it, you could have PM'd me and if (which i really doubt) you were interested in the name raised your issues and we could have worked through them.....

    No, you jumped in and got a rollicking! and then you accuse me of picking a fight with YOU, priceless!

    I'm going to add my pennies worth here - In that Whilst I wouldn't for a moment justify an OTT reply by the original poster, there are better ways of taking anothers 'Spin' out of a post.

    But never the less the amount of TM flags that get raised for 'generic terms' is imho very wrong. JoeBloggs as a term of reference to any 'non-descript person' has been around for many years - Far far longer than the adoption of the term by the clothing company.

    The poster has made clear that usage should subject to due-diligence.

    I couldn't imagine much better name for someone wanting a Blogging domain

    I offered Paul £750 for this name when he first advertised it. I think it is a great name for exactly what Bailey described (a blog), and coupled with the possible TM problems, the £750 is all it was worth to me as it's use as a commercial site is limited imo - even from a branding pov for more reasons than one.

    BTW My offer still stands but for today only :)

    I know this is a 'sales thread' but it's a good example thread of when to add something constructive and from a knowledgeable point of view. And this is specifically directed at those that really shouldn't be commenting around TM's - without the basic understanding of what they're talking about.

    TM law isn't difficult to understand or apply - adimittedly a certain amount of interpretation needs to be applied - but even that element is pretty much common sense.

    yep and I'm still smarting at someones total mis-representation of TMs on my long held domain "couk-techguy". "when in doubt say naught" as my ol'grandma used to say
