domain dropped when registered until 2014

    Hi,

    im looking for a bit of advice...

    I bought a domain (14/04/2012) when it was in suspended status transferred it (nominent) and renewed it with 123REG before it was due to drop. I have an invoice for the renewal and an archive export from 123REG showing that the new expiry date is 17/01/2014.

    I was just about to start developing the domain and was shocked to see in the whois it is now owned by somebody else! They appeared to have register it on 24/04/2012.

    Im guessing the domain dropped and was picked up by somebody else.

    Has anybody any experience of this occurring?

    im guessing ive dropped the ball somewhere just trying to make sure i dont do it again!

    When you say you have an 'archive export' I'm not too sure what you mean.

    Did you at any point check the actual whois record via a general search or did you rely on what 123-Reg had emailed you?

    I've previously registered domains with 123-Reg, received invoice, email confirmation etc then checked the whois to find it is still not registered to me and is showing as FTR, in one case this went on for 3 days and I had to chase them (had I not done so on that occasion I suspect the domain would never have been registered and just overlooked, despite what the invoice said).

    This is one of the many reasons I'm no longer with 123-Reg

    Yep - same happened to me. renewed on the 123-reg base but, not at nominet. When it happened a second time I managed to notify 123 before the second domain was lost.

    I keep saying i'm going to move them away. Just haven't got around to it. I wouldn't trust a Paid invoice from 123-reg as signifying anything these days, and now check Nominet DB as a matter of course

    Andy, if you do a forum search for "123" in this section:

    You'll see quite a few posts where people have renewed domains with 123-reg, only for them to later lose the domains as they never renewed them, despite them confirming they were renewed and paid for. Apparently, according to 123-reg, it's down to the domain owner to make sure that a domain/s have been renewed, even if 123 say they have done so and taken payment.

    Thanks for the reply,

    123REG allow you to download a csv of all domains with them, this is the only evidence(other than the invoice) that shows the domain was registered until 2014.

    I had only relied what 123 had said, which i now relaise was a mistake.

    Ive got in contact with them so it will be interesting what they say, i dont hold much hope looking across other peoples experience with them!

    Thanks systreg i'm just looking through the posts now, maybe I was hasty in starting a new thread!

    As mentioned in the first post I did think it was my failing this had happend. Before now i've had an excellent experience with 123 and kind of ignored all conflicting advice due to my good experience. I may start to transfer them all elsewhere now!

    Can always take them to court, you have losses due to them failing to fulfil a contract due to negligence (for example non failure of a third parties systems, i.e Nominet or ICANN).

    It isn't your job to check to make sure it's renewed. Kev is right to raise it, but that is legal crap from 123-reg that won't stand up in a court of law in my opinion. It's their job to ensure that it is renewed, they took the money for the service.

    Laughable at best! The 'crappie' :lol: some institutions come up with to deter wronged customers from complaining! How can someone take money from you to do something for you, and later lay the blame on you for not making sure they had done it, when they had confirmed to you that they had done the job. Very funny! :lol:

    Would love to see how them try to convince a Judge on that! :lol:

    Never rely on ANY registrar with your domains, get yourself one of the many Whois bulk checkers and keep a list of all your domains. I scan mine at least monthly and check for name, expiry and DNS changes.

    Have a look on nameblog.co.uk for a comprehensive list of Whois servers

    123-reg screwed me the same, the domains show in your control panel but are not actually registered.

    I have even had other peoples domains (and control of) in my control panel. They are a joke.

    The same happened to me...

    Got invoice, paid invoice, checked control panel showed it reg for another 2 years (but it didn’t).

    After speaking to them at length on a premium number, was told there was a bug in there system, but it was my responsibility to check the whois.

    I asked what about their responsibility as a Nominet Registrar, where they had failed to keep to Nominet Registrar guidelines, I was then pointed to there terms and conditions (where it says its my responsibility, to check the whois).

    The same thing then happen about another 6 times after that (over 6 months), had to contact them on the premium number again to process it again.

    Was happy with their service until then, all my important domains I have with them I have now reg for 10 years.

    Shocking they can get out of this that easily!

    I'm not a lawyer but I've heard of the Unfair Contract Terms Act which I would have thought would apply here. Just did a quick search and it seems that section 3 covers exclusion of liability for breach of contract


    From e-lawresources site:-

    S.3 applies where one party deals as a consumer or where there exists a standard form contract. The provisions are subject to the reasonableness test in s.11 and provide restrictions on the other party to the contract's ability to:

    Exclude or restrict liability for breach of contract
    Provide substantially different performance to that reasonably expected
    Provide no performance at all


    Any legal experts on here?

    I'm quite surprised that anyone on here is still with 123reg. They let some domains drop when they shouldn't and renew others that have been set to drop.

    Yes you should be checking your domains, but what about the thousands/millions of people out there who are far less aware of such things? Would they know where to check?

    Absolutely shocking company. If you pay for a service, then you expect the service to be delivered no matter what the T&Cs say.

    People should vote with their feet!

    This would seem unlikely while the CEO of their parent company retains his position on the Board of Directors of Nominet!

    I've been told that it was one reason Nominet didn't publicly announce that 123-reg had been hacked and kept it quiet, they should have told people to check and they still keep it quiet to this day....

    They don't like each other though, that I do know... But they don't want a circular firing squad.
