Drs issue?

    Hiya,

    Just a quick one.

    If i have a plural generic domain and was to offer it to sale to a company that owns the singular and there company name is the singular, Could there be a case for a DRS?

    I guess it depends, if it is a made up word with a trademark etc, then you might have an issue. If it is a generic word or name, and you are not currently using the domain to falsely represent the company, I cannot see how they'd have enough to take action, though they may try!

    Possibly. Anyone can start a drs for any reason. All they have to do is tick they have rights and tick they believe its an abusive registration because you are already aware of the goodwill they have in the name.

    If you are charging less than £1k for the name then they would be silly to go down the drs route. Ive never done it with names I value above £1k for the above reason. Others probably have.

    So it's even with product domain names?

    If you had a name like bowlingballs.co.uk and approached a long standing business called bowlingball.co.uk there's a chance they could take it off you?

    It is possible, however you would have to be a complete plank if you could not present a robust enough response to the DRS.

    Doing outbound will put a chink in your armour when it comes to defending a UDRP/DRS. Still defend-able but why go there.

    Approaching to sell plural, singular, misspells other tld cctld etc you'd be silly not to think there could be consequences. With Drs and urdp often cheaper than seller’s price it’s a route they’ll often choose (well the threat at the very least?) its all part of the game:eek:
    They’ve built up the business and see you as just trying to cash in on there hard graft. It’s down to argument/reason for registration and panels opinion in the end ? But don’t be surprised if they attempt to use your approach in any actions?

    The stand-alone domain may be 'generic' but is the company branded around it ?
    Apple is generic after all.
