Yes mate that is basically what they're doing. Well I'll file a claim tonight and see where it goes.

I think Tim Beresford's behaviour in this is quite frankly shocking.

Hi,

I would suggest the following:

Start your small claim for an unspecified amount but a max of £5k.

Apply to the court for injunctive releif to force Heart Internet (at a minimum) to return your database data to you, so you can mitigate your losses and get your sites back up and running.

Do this ASAP, i.e. tomorrow morning both at the same time and for the injuction make sure you say that it's an emergency and you may then get a hearing sometime this week.

If you then get the Injunction and Heart Internet do not comply, they are then committing a criminal offecnce.

I did what you suggested and asked Heart Internet to reconsider with this in mind, I have beeen granted 24 hours to move everything I need.

It seems to be getting sorted although I'm not over the moon with the money I have paid to set things up and they have broke the agreement.

So I may still persue them, only thing is that now it's not putting me in such a bad position with losing my sites on a tempoary basis.

Well I'm not going to make any accusations that I can't prove at the moment, but I suspect Heart Internet of some pretty underhand stuff on one of my sites. I intend to take it to court shortly on this and other issues.

As a warning to everyone with them, be very careful and take regular backups when dealing with Heart. What happened here is very unlikely to be a technical issue.
