I've only recently thought about buying and selling domains as a way to make some extra money so I really don't know a thing!!! But, I do have an idea for one domain name. It's a major network with the word podcast (www.nameofnetworkpodcast.com) at the end of it. Not sure if that's copyright infringement to buy that domain name. Obviously I won't sell anything on it, just the domain. My other question..... I know that podcasts are becoming a big thing for the networks. But, is this something they would even want to buy if/when podcasts get even more mainstream ..... I ask cuz they probably have their actual podcasts on their website - ie.... www.bignetwork.com/podcast.html? Thanks and looking forward to replies! yes if the Network name is copyrighted/registered and you buy the domain then they can DRS you and possibly leave you with a hefty legal bill. try generic domains like ironingboards.co.uk, that way your not treading on anyones toes! |

That would be infringing their intellectual property so it doesn't sound like a good idea to me (unless you could claim that the name was generic). See also: http://www.webref.eu/domain-name-trading-resources.php

My standard reply to most posts about 'is it trademark infringement?' is: "Yes. Plus even if they haven't registered it, it doesn't matter. If they have been trading with it and the name is 'out there' then they have unregistered trademark protection. So they can still get it off you if they have a half decent solicitor and a bit of cash (which some podcasts networks do!)" Most of these things aren't worth the risk unless there's massive traffic to be captured from the name. So that you could make a bit of money in the short term and then hand it over when they come knocking. And if you are getting a lot of traffic to the domain, then they will come knocking. Good luck
