Was the seller not in violation of sedo's terms by having the domain listed for sale at other marketplaces?

Or was this just a brokered sale?

The important thing is that Sedo doesn't have any performance clause in their contract so it's difficult to see what a court can do. You can only sue for loss or to force someone to perform (transfer a domain or make a payment) and as neither party has suffered a loss and with no performance clause what other remedy can a court hand down?
