I've sold my first domain and the buyer is telling me to complete the transfer form and send to him so he can fill out section 5-8 and send on to nominet. He says he will then make payment. I'm not happy with that and said to make payment first and I will then send the form.

If I send to him have I then lost all rights? should we be talking escrow?

    Money first, forms later.

If he insists on escrow then escrow.

If you send him forms and he completes the transfer, you no longer have any control.

If the buyer won't send you payment first, then you could offer to use escrow - You could either split the cost or one of you pays, depending on the value of the sale etc.

NEVER send the form first. Once they have that, they can have the domain for free.

I'm obviously posting too slow today :???:

You can send forms before as it dont matter now as you have to send proof of ID before Nom will do the transfer.

Now I just send the forms out before payment.. that way it encourages the buyer to make payment quicker.

Be careful about doing that, they've not always asked me for the id ;)

you're a brave man aqua, relying on Nominet's checking process!

though, it is a contract and you could pursue them in the courts for payment even if they did run away from initial payment.

I don't know if Nominet would transfer the domain back to you - anyone know of any case history?

The nominet forms tell you to attach the letter and id to the forms.

I treat it like any other sale, the buyer pays before the goods are shipped.
I can't be bothered with Escrow.

BTW Nominet have never asked me for any identity.

You wont have to give ID Carl as you put trading as company or Ltd company.

    Where those company registered?

So far all my personal reg'd ones have required ID on my part.
