Right I know someone who had registered xxxxx.com and this is their trading name. Someone else has set up a similar venture with xxxxx.co.uk (xxxxx is both the same).

As you can imagine all hell is about to break loose, what right does the .com (reg'd first) have to claim .co.uk?

Both ventures are identical although domains registered 2 years apart.

Depends what it is mate, where there business is aiming, i.e US visitors with the .co.uk targetting UK maybe a factor.

Why didn't they register the .co.uk if it was a big factor? Is their name trademarked?

There's lot of things that come into it, so anybody would be guessing with an answer mate.

    both in the UK

Sorry tried to be brief without giving too much away!!

Both are trading (exhibitions) in the UK. No idea why when .com was reg'd they didn't reg .co.uk !!

Name is not trademarked. Other than .co.uk picking up traffic from .com when people use that, is there really a case?

    Rgds,
    Scott
