The quick action by nominet is a clear demonstration of CMS not comminucating with them - before I went on holiday I raised this matter with CMS (the missing documentation, which I suggested could be put back on the site - they said they would discuss it with Nominet) ;clearly they didn't in any reasonable period of time - and who are Nominet getting to do their WHOIS sftware? They take ages to make a change to a sunrise whois (I had been waiting for changes before too) - Nominet are not covering themselves with glory here.

You might want to confirm with Nominet whether CMS did or didn't speak to them about your request. You could be correct in your assumption, but better to check.

It's in house. The data is archived and they've told me they need to link it through to the sunrise WHOIS again. I've had three emails about it and they were in the final stages of testing it. I know they don't have staff sitting around waiting to do things so I can accept that it takes a bit of time from when they initially received my email, through to making the data available again. I don't know if anyone other than me sent them a request via email for this data to be made available again.

"Flimsy" indeed, you can see why I got so upset about it. Will Nominet do the right thing an reverse some of the decisions taken by CMS Cameron McKinnon?

On the one hand, you have to respect the individual for going to the lengths to follow the rules and get his applications in. It shows great ingenuity on his part.

On the other hand, you have to say that Nominet and Cameron McKenna should have done a better job of interpreting and using the rules such that the system couldn't be played in this way. They probably should have realised something strange was up, and looked at the policy when the same person put in applications for a range of completely un-connected trademarks.

If the rules have been followed yes, but by looking at some of the rules against the evidence it would appear that there may be instances where this is not the case (which is what this thread is exploring).

Anyone who has broken rules should obviously not receive credit for ingenuity.
