Domainlore seller is backing out (falbros)- no protection offered

    So I've bought a few domains on DL over the last week. I bought liverpoolproperty.co.uk and today liverpoolproperty.uk from a different seller. The seller is claiming it was wrongly put for auction and is refusing to transfer/sell the domain to me. I am not ready to accept that. Denys at domain lore doesnt have much to say in offer of support which I'm more than a little surprised at, I would have thought he would have by now some understanding of the nature of the binding contract and how to enforce it.

    What can I do?

    They will almost definitely end up being banned if they don't honour this sale so I would remind them of this. Denys probably won't have much to say until 2 weeks has passed, going by personal experience.

    Interestingly I actually caught liverpoolproperty.uk, however i deleted it for a registration refund (Nominet allow members a small percentage of registrations to be refunded if deleted). It seems there was more interest in it than i envisaged. I was hoping to catch the pair.

    It was subsequently re-registered by the current owner, hence the different registration dates.

    Theres not a lot Denys can do apart from ban them after 2 weeks. Ive had success with the name and shame routine especially when Acorn threads get into google search.
    Its quite funny when you get back to them and say "Hey, have you googled yourself recently?"

    Could you please clarify which of the .co.uk or the .uk owners is the one holding out on the deal? Your original post was a little unclear. Thanks!

    Id say its the one admin doesnt own ( according to whois ). ( the .uk )

    As others say, DL works well because sellers who backtrack lose ratings and/or get banned.

    Other than that, there's no protection - it is what it is.

    The same's true on here though. I agreed a deal on icepop.co.uk and the seller reneged. Some people just aren't worth doing business with.

    Is it supposed to be mandatory to set the name server records for any domain name put up for auction at Domainlore to those of the auction site? If so it would seem from the WHOIS that name servers for liverpoolproperty.uk have not been set since the domain name was last registered.

    No, it is just recommended to update the namesevers rather than compulsory.

    I was the .co.uk seller - just to clear things up, I wasn't aware @Lovekraft had deleted the .uk before I advertised the .co.uk on Acorn. The .uk was swiftly checked and regged by, I believe, an Acorn member who I shan't name yet as there's still the chance to rectify this amicably.

    To mistakenly put a domain up for auction seems farfetched. This matter should be nipped in the bud and the auction result honored by the seller if he stands any chance of keeping credibility, within the domain community and outside of it - he still would have made a quick profit!

    A quick apology and transfer would hopefully brush this under the carpet, lesson learnt!

    There is no comeback on Denys, he doesn't charge you if it sells, so there is no contract with him.

    I disagree that he cannot help just a little bit. I'm only after a heads up, a little insight on the next step etc. In fact his terms offer mediation support and he talks about a binding contract. He must know more than me given it's his business and he has overseen thousands of transactions. His rules here https://domainlore.uk/auctions/rules/ say:

    Once you list a domain name, you are accepting to be entering into a legally-binding contract with the highest bidder. You are obliged to sell your domain name at the highest bid price, with the Reserve Price auctions as the only exception.

    And

    While we cannot promise a satisfactory resolution, we will try to contact both parties and help mediate the situation. Any illegal activities, violation of a contract, or outright statements of falsehood should be reported to us immediately. The DomainLore staff will cooperate with any law enforcement agencies if needed, and will at the least terminate the offender's membership.

    Ryan at Falbros is the owner, anyone know him or the company or their reputation?

    The director of the company is Alex Ewen, Ryan is the secretary so maybe make contact with him, though they are likely to agree. Also, as the domain is owned by a company, the claim against them is even more likely to be found in your favour, and damaging to their business. Strange that they claim they didn't mean to advertise, yet bought westminsterproperty.co.uk on there at the same time!

    I had some dealings with Ryan back in July, he requested a quote for some blogs and articles, then just kind of faded away. It was for an expat mortgage site.

    Yes i had dealings with Falbros just recently as a result of a member on here brokering for them and buying 2 of my domains. To be fair they were entirely honourable on that occasion. I'm hoping they can turn this around for you.

    For clarification I sold them that domain & received payment same afternoon. Just waiting for them to complete transfers following a TAG change.
