Company's right to a domain name

    Just want to know if a company has a right to a .co.uk

    The company's name is not TM
    well established company with a few branches and main operation in the UK
    already own and using .com only main website.
    .co.uk is the same as the company's name.

    Say if this company decide on a lawsuit what's the chance of winning? should a domainer give in and settle for a low price?
