WeightedVoting.uk has obtained two opinions from Iain Mitchell KC. They deal with whether Nominet's weighted voting is lawful and whether Nominet currently has the power to collect member subscriptions.

Based on the information available, Counsel concluded that:
  • Weighted voting is "clearly unlawful" and "void"; and

  • Subscription demands after 31 August 1997 are "void"
We researched the history of these issues online. We also asked Nominet and said that, unless they had anything to show us, we would proceed on the basis of what we have. They did not tell us there were any additional bye laws published that we should have been looking at. But if anyone has any historic or current information that we don't have, please share it with us. We want to make sure we get this right.

We waited until after this week's board meeting before publishing the second opinion and our most recent letter, in which we asked the board to work with us to fix the "mess" counsel described. When we did not hear back from Nominet. With the AGM looming, we decided to publish and give members and stakeholders the information that we have.

You can read the two opinions and our letters to the Nominet board at WeightedVoting.uk

We'd ask members who agree with us that this needs urgent attention to sign up to show that they support that call.

This is not a new issue. It's been raised before, including before and then at the 2020 AGM, when Mark Wood confirmed that Nominet's legal advice was that it was lawful. You can see him deal with it here.

These are fundamental questions of Nominet's governance, dealing with how the AGM and election takes place. Please any questions you may have about it. We'll do our best to answer them.

manipulating the process of planning laws to grow his woodland business and made millions doing so

Since when do you need planning permission to plant a tree?

Seems like it's okay for him to bend the truth (basically lie) but for some reason he doesn't like it when Nominet might be testing the limits of the law.

Maybe you'd want to remove this defamatory comment William (who's apparently Welsh, but hates his fellow Welshmen).

I'd be careful of reading anything on there because that guy is known to jump to conclusions that are a massive leap of faith at times. However, that blog post does sum up the gist of it all.

I haven't formed any opinion either way as my day job is in property and I'm aware how bitter people can become. Just thought it would add some context to what you were trying to say.
