Hi All,
I'm interested in registering a unregistered domain which is the name of a music company which as far as I am aware is no longer in business? they might of been bought by a larger company years back.
If I was to register it, is there any implications in doing so? i.e. can they grab it back?
 
Go ahead and register it, at least you've then got it registered. It doesn't cost much to register a domain, so the worst that can happen is you lose the reg fee if they want it back.

People can take domains back off you if they have sufficient legal claim, particularly if they have a trademark on it, so check the trademark register if you don't want to waste the reg fee.

If someone rang me and said, give me the domain or i'll sue, i'd transfer it. (with a good case, naturally).

At the worst you have traffic until that happens.

Those people who decided to take on the BIG boys are mad. A chap in my town who I know, ended up losing hs case and faced £10k court costs, seriously! All over one domain? In that time and money you could have 10 more domains much better than the original.

Suppose I better take mircrosoft.co.uk (11 w/ext) out of the reg list then ;)

Before you panic and bottle it ,refer to the One in a Million case and the reference in that to "...no tort of going equipped to pass off exists.." that having been said by the Court. In other words, so long as you are not actually pretending to be the company involved you have no fear. Best also put a disclaimer on it, and if it is very obvious close to their trademark then look up what classes it is in and avoid that use ! At the end of the day I am happy to take over any domain name taht you dont want to be sued for and I shall give you 50% of the amount squeezed out of them !!.

Ha ha. Knew that one was coming. Reminds me of my favorite chat up line:

"Hi, i've forgotten my phone number... Can I have yours?"

It's cost me a lot in dentist bills that one :cool:
