Well I hope so. The very large corporation suing me in the
USA filed an "in rem" claim against one of my domains
,not myself but my domain (which apparently means the
domain name itself is the defendant,lol). I filed a motion
and the Court accepted me as an interjector. Then I yesterday faxed copy of the Judgment to the Judge and
await his decision.

Thanks and good luck to you too. At end of the day the
first contacts and how you handle them are CRUCIAL,
as is what is on the web site. It is clear now,as far as
.com goes, that if you use your sight for ANYTHING
remotely commercial, even if it is not the same product
as the aggrieved parties, then you are at great risk
under the cybersquatting legislation of the USA,
IF it is a US Company who is suing. However,it is also
clear that as long as the domain is only used for
a NON commericial basis, such as highlighting problems with the complainant THEN you are OK.
My own one could be compared to where they announce
"we have found a field that contains millions of barrels
of oil" BEFORE they have bought the field. I then step
in and buy the field before them. Is that so wrong ?.

Beware of people "bearing gifts" .i.e. if someone sends
a mail to you saying "do you want to sell the domain"and
it is in anyway a possibly contentious domain, check
them out before replying (via their IP)
and let them make the running on the price,i.e. "...make
an offer...". Sorry not interested etc. I checked my
logs (and IP's) on a domain yesterday and who do I find but a Trademark Lawyers firm has checked both the ,.com
and ,.co.uk domains so I KNOW they are fishing around.

Trouble is sometimes too clever by half,and can backfire
sometimes.
As for Axalto etc ,you could always try contacting them
through hotmail account,yahoo account or even phone if
in UK and say something like "can you tell me what
your web site address is please" ?. "I tried axalto.co.uk andI cannot get you at that address..."
give em a few heavy hints etc etc but not from you !
They'll then go and try and register it and,bobs your uncle........
they'll sue you, OR BUY THE DOMAIN !,lol.

To submit an appeal against a registration costs £750 + vat.
I'll sell for £500.
Thereby saving them money and time! :)

Sky might be a better one to contact regarding Premplus.co.uk.
I'd have to do it by email though...if I phone them they'd want to sign me up. :razz:

ATM they only sign up via phone.
You cannot sign up online but PremPlus still gets about 150 hits a month (with no weblinks).
I suppose if they decide to offer online registration for PremPlus they'd come looking for me.

Btw, do you think they would own the right to PremPlus.co.uk?

they come on heavy and then cave in when they know
you'll accept £500. Its only when you want thousands
for a name that they start thinking seriously on Nominet,
WIPO,Courts etc. Ive got one name that is a like
US500M project so I quote them 2.5K but no reply as yet.
Surely thats a drop on the ocean for them ,but its their pride at stake,

Maybe they think you'll jack up the price if they say yes!
And maybe they think you'll drop it if they don't reply!
Maybe they're not in a rush?

What would I do with Premplus.co.uk I would check
http://www.patent.gov.uk and search trademarks to
see if anyone has the trademark. Either way,if I didnt
want more than £500 I would email premplus.com OR
anyone that obviously has an interest in Premplus and
ask them straight out if they are interested in buying.
I would not state a price straightaway,just ask if theyre
interested . Why not quote a price you ask ?. Well because
if you do ,when they reply saying "no" you dont now
whether it was price or just because they dont want.
If you leave it blank then they may reply and say
yes. Then you know that they ARE interested and then
it all boils down to price.

Thats ok then. With trademarks what you have to remember is that the Trademark only covers the classes(products) it is registered for. So look up what classes they have under
xyz name and then when/if you get asked say you were
planning something in a class they have'nt got.

Hi,
Remember a business can have exclusive rights to a name even if the name is not trademarked, be careful! I also don't recommend contacting them by email in regard to purchasing certain domains. This can and most definately will lead to DRS in many cases! Should they decide to take it through these channels regardless of your price it will weaken any future cases you may encounter. Phone calls are the best method imo. Gud Luck!
 
Yep agreed you do have to be very careful how and whom
you approach. For example, I know from experience,
someone like Warner Bros will sue your arse rather than
pay you £500,whereas others will be happy to pay
£500 even though its their name. Just got to think how
to approach before and check how tight and well known
their trademark is,whether they are household name.

Youre right about the phone calls also, get them to
agree to buy it and make sure youre taping the phone
call so once they agree to buy youve got them.
