Is it within nominets T&C or just legal in general for a person to actively sell domains to have there whois as:

The registrant is a non-trading individual who has opted to have their,address omitted from the WHOIS service.

Just wondering :) as if there is selling domains happening, surely they are "trading"?
 
Would depend I guess if they were doing it on a regular basis? I'm not sure if this is a legitimate comparison, but if you buy a car and then sell it you aren't necessarily a trading business, but if you purposefully bought cars to resell you would be.

Only domain name holders that are non-trading individuals can opt out of having their address details published on the WHOIS. In other words, if you do not use or plan to use your domain name for business, trade (this includes the registration of domain names for monetisation purposes, e.g. pay per click advertising etc) or professional transactions, you will be entitled to opt out of having your address displayed.
How can I opt out?

Cheers guys, It's safe to say most people on here don't have one or two names that they sell, so If i started buying and selling even 10 cars a year technically I would be trading, I guess it's a fine line between hobby/business but If your earning from it I guess your classed as trading.
 
Bounce the name over to Nominet support and let them make the call as to whether the opt-out is valid.
 
It wasn't a perticular person, a conversation Came up about something similar earlier when I was out, just made the link to domaining, useful to know though.

So pretty categoric that anyone selling a domain cannot opt-out of the whois.

I've contacted Nominet several times over the years on this subject and the whois details have always been made public within a few weeks.

Someone just drop catched a domain I was after and they are "non trading", yet directly below says <name> t/a <company name> lol.
 
You can have a company or trading as owning multiple domains and all ok to opt out of the Whois.

It's on a domain by domain basis. So if the domain itself is not trading then it can be left out of the Whois.
 
This is definately becoming a can of worms, the lawyers would love it. As for other peoples registrations, I like the old saying

"Those that live in glass houses - shouldn't throw stones"

Opting out of the public register is done by registrant account, not by domain name.

Check "account details" in the Nom system for each registrant account you are using.

It's in everyone's interest that the WHOIS is up to date and accurate.

I have a vested interest in there being confidence and trust in the Internet and .uk domains in particular, and so will continue to raise incorrect WHOIS details with Nominet as I come across them. :p

You should have booked the domain with catchers as suggested to you by others last night. I don't know what the name is but I imagine the catcher will want more than it would have cost you to make a no win no fee booking (£30-40). :)
