I regged

the payment was accepted etc... and then they sent me an email saying that they were not authorised to sell it!!!


Do I have any claim on that domain??????
 
yes, they explained all that. But, why did they take payment of it and send me confirmation of purchase???
 
You could write to them and advise them that you consider that you have rights in the name and that when they overcome their technical problems with the use of the name that it is rightfully yours. Did it show on WHOIS as registered to you ?. At end of day it will be down to the fine points in the terms and conditions as they may well have final say.Shame, you couldve been a millionaire !!

The law as it stands says you must be able to prove any out of pocket expenses.

If you buy something for a fiver and it goes wrong, for whatever reason, the sellers liabilty is for a maximum of £5.

If you buy something for £5 and it causes you some kind of physical or mental injury. You are able to claim for medicines, days off work, phycological councelling etc plus a small nominal amount for pain & suffering.

If they don't give you, either the domain or your money back, you could take out a County Court Summons to recover the the reg fee. :D

It was through 1and1.co.uk - they offered me the reg fee back but I haven't taken it yet??

Do I still have claims on it if were ever to be released..thinking about it, it must have been at least two years ago!!

I think that if it appeared on WHOIS then you *may* have some kind of chance,but as I say it may well be that Nominet have terms and conditions that will make it impossible to claim the name. In strict terms I suppose if they billed you and you paid then some kind of contract exists, but...

What is the value of 1.co.uk Lex?, how can you put any value on the domain other than the price you would pay for it?

Its a bit more fundamental that that. 1.co.uk is a one Character domain name, and thus is prohibited under Rule 5.5, see:
http://www.nominet.org.uk/registrants/legal/rules/

I very much doubt that the Automaton accepted your application - so you'll have to speak to 1and1.

I've just had a word with our legal team and you definately have a case.

You could take 1and1 to the cleaners - 6 figures they reckon.

If you want I can put you intouch with a specialist who'll take on the case for a £20,000 downpayment and 40% of any compensation.
 
Problems that exist, time limitation, acceptance of returning funds and for a contract to apply 1and1 had to have capacity.

It seems there was never a question of capacity, there system probably accepted the funds without question, then they realised they couldnt supply.
