Apraisal is sueable being honest as your taking their name and using it for a start and they have a very strong case against you as they can say that you are trying too con people into giving money etc etc.

Would be 10 times worse if you had a website up.

Regards

Mark

Whos name has he taken?!

Escrow is a noun... and Escrow Funds... a descriptive phrase?!

I wouldnt want too risk it anyway

Would be the same as having something like paypalfunds

and you know how much Paypal would screw someone, they close accounts fast enough so when it comes to using their name god knows what they would do.

Speaking of which www.paypalfunds.co.uk is available ;)

Nah I'm tempted but even I wouldnt risk buying it lol could have some use if you can get away with using their name but even I'm not that brave.

Nope I'm going too stop as otherwise I'll end up buying loads of domains that I dont want

Just went through a short list of related domains in my mind and a lot are available and could make a lot of money via referal fees etc etc but would be so hot wouldnt need to goto hell.

I have no idea what you are talking about

escrowfunds.co.uk is a domain name... for sale

what are you talking about

Easy really

Escrow a company, Paypal a company

Now if you buy a domain related to Paypal chances are that you will get their lawyers crawling up your backside.

Do the maths

dude that makes no sense.....

ok

stocks.com......well Merrill lynch will be up my ass if i owned it.
Bonds.com ...ok, goldman sachs would be up my ass
Popsicle.....now i have to worry about the popsicle company
Gas.com oh i should watch out for Chevron

Escrow funds is an action!!!!!!!!!!

have you ever closed on anything?

unitedstatesamerica.co.uk obviously says a lot.

Try buying a trademarked name and see what happens, try buying something relating too ebay or setting up an auction website on ebayupay for example and see how far that gets you.

Your making stupid arguements such as gas.com which is a natural commodity which isnt really owned by anyone.

I could buy probaly about 20 domains within 10 minutes based around Escrow, Nochex, Paypal, Ebay but I wouldnt as its not worth the hassle.

I could put the website up and earn revenue on Paypal sign ups etc, but I can bet you a dollar that Paypal will shut that account down and take back any money owed.

There are a thing called terms and conditions, trademarks and copyright, so dont try and say nouns and crap like that as you havent got a clue.

Escrow is a generic term, not a company name such as Paypal???

Oh and another thing

This is for valuations not for sales, so GEEEEEEEEEE I think you posted in the wrong forum.

Think you should be in co.uk sales if your not asking for a value just trying too sell the domain asking for people too PM you.

So gee look at me I'm so dumb that I can tell the difference between a for sale post, and a give me a value post.

Escrow.com is trademarked www.escrow.com it might even just be trademarked under escrow.

All Escrow.com web pages are secure and begin with https://
Never download or open a file or picture from someone you don’t know
Escrow.com does NOT send emails with payment or shipping instructions.
Escrow.com does NOT accept payment through Western Union or Money Gram.
Escrow.com does NOT have escrow agents.
Looks Too Good To Be True

This is a bit from their main page regarding fraud so apart from being trademarked if someone sent out emails from escrowfunds.co.uk they could be accussed of trying too copy escrow.com

Just because someone trademarks a generic term WITH the extension doesnt mean that people can't run businesses or own domain names that contain that generic term.

It might be the generic term that they are branding, I havent looked into it being honest, but as I say try buying a domain with ebay or disney involved in the name and your soon see about trademarks and copyright etc.

es·crow /n. ˈɛskroʊ, ɪˈskroʊ; v. ɪˈskroʊ, ˈɛskroʊ/ Pronunciation Key - Show Spelled Pronunciation[n. es-kroh, i-skroh; v. i-skroh, es-kroh] Pronunciation Key - Show IPA Pronunciation Law.
–noun 1. a contract, deed, bond, or other written agreement deposited with a third person, by whom it is to be delivered to the grantee or promisee on the fulfillment of some condition.
–verb (used with object) 2. to place in escrow: The home seller agrees to escrow the sum of $1000 with his attorney.
—Idiom3. in escrow, in the keeping of a third person for delivery to a given party upon the fulfillment of some condition.

So maybe in respects they cannot trademark the name escrow as much as they would like but anyone using the domain name would still need to be careful regarding legal matters as most people would think that someone sending an email from escrow funds would be associated with the company/website and might be looked at for dodgy dealings.

In some respects thinking back a well known burger chain tried stopping people from using their name Worldwide even though there are probaly a few hundred jocks with the same name, I think that was in the 80s or early 90s as was on the news.

Thread trashed with nonsense methinks. Nice domain name!

You haven't looked into it?? but you posted this a short while ago implying that you know exactly what you're talking about:

There are a thing called terms and conditions, trademarks and copyright, so dont try and say nouns and crap like that as you havent got a clue.

Disney and Ebay domains are totally different to this domain and can't be compared in any way!

I havent looked into the full legalities of the trademarking process regarding escrow simply because its sunday and if someone wants to buy the domain and run any risks, that is up to them.

The chances are the domain is only trademarked as someone stated before, they are words in the English dictionary especially escrow so in some respects could you really trademark the word Zoo if you brought www.bristolzoo.co.uk as a domain name or even www.zoo.co.uk.

Still hes only seeling rather than wanting an appraisal from his post, so thats one thing I'm 100% sure on without looking into the legal aspects of trademarks when I'm chilling doing some work at the same time.

i cant believe you can sit here and tell me that EscrowFunds.co.uk is tradmarked. That is the dumbest thing i have heard all year. Dont reg it because of paypal.....or escrow.com.....give me a break. Do you even know how trademarkes work? This isnt even worth a reply, thats how stupid it is.

Thanks for people that understand domains and appreciate the ones speaking up and hopefully shed some light to this guy.

"nice domain" thanks.

I never mentioned www.escrowfunds.co.uk was trademarked, what I said was that Escrow might be trademarked and therefore someone using Escrow might be breaking trademarks.

So the keyword is Escrow and not the funds part if they have trademarked Escrow rather than www.escrow.com as a domain name then as your not using Escrow in the sense that your calling yoursel www.escrow.com then things should be ok.

If you or someone else who buys the www.escrowfunds.co.uk is using the domain pretending to be escrow.com then obviously yes there is a trademark issue.

As I say right or wrong, your still posting a sell in a appraisal section and just asking for offers or advice.

Apologies for being blunt, but if you haven't got the message yet that 'escrow' is NOT a trademark, then I'd leave this thread alone if I were you.
