In late 2008, Nominet dismissed Jay Daley, then Director of IT, for gross
misconduct resulting from breaches of trust and confidence. Mr Daley then
brought an action against Nominet in an Employment Tribunal to contest
this decision. The Tribunal announced on 20th May that it has upheld our
finding of gross misconduct, and that Mr Daley was fairly dismissed in the
circumstances.
In February this year, a High Court judge awarded Nominet substantial
costs against former non-executive director Jim Davies in relation to our
injunction application that he comply with his legal duties as a Director.
Mr Davies' lawyers have recently conceded that he will not continue to
dispute this finding and our costs will be paid.
We hope that these decisions will draw a line under some of the difficult
issues that we have had to deal with over the past year.
