I know a domain name for sale,

Its the .co.uk of the name of a well known group, i would imagine there name is trademarked.

If i bought it and parked it with adds of maybe a fan site with ads could they take it off me.

The domain has just sat dead with the owner for 4 years.

    Cheers,

what if i invented a made up product, the initials spelt out the band name.

And then put ads around it.

Im not sure i see people who own celeb names and made fan sites.

I dont think people have hard evidence as to what can actually happen.

    2 things >

1, A name you use doesn't have to be the same as a trademark but only similar in order to breach interlectual property rights.

2, You have publicly admitted trying to pass off trade from the company involved.

I suggest you find yourself a generic to play with :|

Yes i did, please tell me what my name is and where i live? you cant :p

Im suprised forums like this are not full of those legal types that can give hard info.

Can i ask your source for knowledge doodlebug, or have you been witness to similar situations?

Even a solicitor barrister etc could only give you advice on the information supplied you would put forward your claim with any collaborating evidence/ possible mitigating circumstance etc they would give an opinion based upon the evidence presented to them.

There are loads of things you can do with web sites that are or could be construed as illegal… This is not a forum for illegal activities.?

If your thinking of doing illegal activities probably best not post those on a forum would be my advice...? especially after posting domains on here doesn’t take a genius to trace in back

It's amazing what you can get from databases! All it takes is a domain name, company name or address and you can get all sorts of information like phone numbers, credit ratings, addresses (which can be seen through Google street view), family history, company history, cost of property, date of birth and the list continues. The point I'm getting at is there are plenty of members on here who have access to such information and my warning is that your name and this thread are now together. If you're ever in a dispute with a domain the chances are you will be looked up and acorn is well indexed in Google. This is just a friendly warning and I am no expert in domain disputes, but be careful what you say and do because it may come back to haunt you!

When I first started with domains I registered several trademarks and used them with the eBay partner network and the like, but after advice from on here and seeing plenty of examples where not only was the domain taken, but compensation was paid, I believe I’m reformed! Hopefully you’ll take our advice, build a decent portfolio and learn from your mistakes.

This was the purpose of the thread to work out if its legal or not,.

But i have not really had a clear answer.

    Surely lillyallen.org is "passing off"

There is a grey are for things like this.

This has been answered many times before.

If you squat on someones trademark or brand name then you open yourself up to losing the domain and possible legal action, particularly if you're parking the domain and it's showings ads for rival companies.

If someone else is getting away with it it doesn't mean that you will too and it's the lamest excuse for doing it yourself.
