.uk domain has been registered by someone else

But the other owner registered AND paid for this as it was available and so has done absolutely nothing wrong. Why should the new owner now be made to give it back? How can you be 100% certain?

Nominet can retract registrations. It's in the T&Cs. They've actively done this due to their errors as long as I have been aware.

When was it registered initially? Has it gone through the 92days release cycle?

Take screen printouts of your registrar account pages to show that it is live in your account. Print out the invoice as well showing registrar & registration details. You'll probably need them for proof of purchase by Nominet.

I actually paid for registering the .uk too why should I lose it like this?

If you've genuinely paid for it I would imagine you'll end up with the domain and the 'other' buyer is going to be out of luck here.

Did the payment definitely go through ? If there was a billing issue and you haven't actually paid for it even although you thought you did, it could be a mess to sort out.

From what it appears he didn't confirm the .uk 2LD registration within the period of time required and it was deleted. It doesn't go through 92 days in this respect.

OP: did you register it with the same or a different registrar to the .co.uk?
 
Imagine though if someone registers a .uk innocently, which isn't noticed by the .co.uk owner for months/years. By this time the .uk owner may have put major effort and money into developing a site, or even sold the name for a large amount. What a messy situation that would be!

If that's the case shouldn't the rights revert to previous registrant i.e. .co.uk even if it was him that registered the .uk. If not that's a massive loophole!

They shouldn't be able to do that. Refer to the thread I linked to, started by Bluerock. If a .uk 2LD is registered at a different registrar to the 3LD which holds the Right, the .uk 2LD is suspended in the WHOIS until the 3LD registrant clicks the link in the email Nominet send them. After 14 days, I believe, or whatever the time period is, without that link being clicked, the registration attempt fails and the right should return back to the associated 3LD. The .uk 2LD never enters the zone file, therefore it is never actually registered.

I don't actually recall getting the email from Nominet, naively I probably thought as the hosting company asked me if I owned the .co.uk and I saw my name as the registrant that all was fine.

It should do. Is this what the OP is claiming didn't happen or are we actually thinking that the Registrar deleted the domain name for some other reason, perhaps data quality?

Can you check through your emails from Nominet and post the bodies of them here, so we can see what you received? Anything about data quality?

All supposition til we find out what Nominet say.
 
Just to clarify a couple of things here. From the OP's first post:

when I went into my host control panel it shows the domain in there and regged until 10/06/2016 with auto renewal.

So basically you registered the .uk on 10th June 2014.

If you fail to click the verification link in the email Nominet send within 14 days (I think), this domain would've reverted back to just showing as .co.uk having rights (I tested this myself on a few of my own domains).

So only a couple possibilities:

1) The OP failed to click the link, and then due to some bug in Nominet's system rather than revert the domain back to having rights, it went ahead and deleted the domain (again it would've been a bug and not the normal behaviour). This means it went unnoticed between roughly end of June until 18th October as being available.. (In this case the OP will get the domain back from Nominet I'm sure).

2) The OP clicked the verification link and now the domain has been deleted by his registrar for whatever reason. (In this case I can't see how the OP will get the domain back).

If it's the same Registrar I thought Nominet didn't email the registrant of the 3LD with the right. Therefore why would the registration be subsequently deleted, other than for data quality reasons? Why would it even be deleted for data quality reasons if the 3LD with the right hasn't also been deleted?

Okay. So according to 3b with this Nominet document you shouldn't have had that email if the .uk 2LD was applied for at the same registrar as the 3LD with the attached Right. An application with a different registrar would trigger that email (see 3c). Maybe it was the same member but a different registrar tag used? Do TSO have multiple tags in use under the same membership and, if so, do Nominet consider that to be a "different registrar"?

If it was 1&1, you'd have an invoice from 1&1. Do you?

Do you remember requesting 1&1 or, alternatively paying Nominet £10 + VAT, to tag change either domain name to TSO?

No I paid TSO on the renewal date for the domain reg fee, I've never paid nominet for any domains to change tag when I've changed hosting accounts.
