Seller doesn't want to complete ownership transfer form

I have just bought a domain off of someone from the US, he has pushed the name to my account at 123-reg and is adamant that that is enough to change ownership. I have told him three times that they will need to fill in the form and send it to me (with links to various websites on how to go about it).

They're ignoring my comments and they're now asking for trader feedback...

It only costs them the price of a stamp, or nothing if they edit the pdf. But nope, they're ignoring me.

Advice? I have control of the domain but don't own it legally (Do I?) :(

I don't think you can ever really own the domain unless you can change the owners name so control isnt enough. Most folk don't get it though, with a .com/net you push they have control job done. It is more usually ignorance than anything, but the job isnt done unless they do the paperwork so threaten for a refund/chargeback unless they do the job properly.

No, you definitely don't own it legally. Do you have their fax number? Perhaps you could print out a copy of the Whois (which should still state them as the owner) and attach a cover letter and fax both to them. Might get them to pay more attention than to email because it looks more "official".

Generally, I never let people "push" names to me before the paperwork is complete - it makes it too easy for them to feel that they can relax and the transaction's done. Doesn't help for this time, but maybe worth thinking about for future transactions.

I'm contacting who I suspect originally registered the name, a web design company, and see if they would like to complete the form for me. I'm paying for the Nominet Transfer Fee so I can't see why they wouldn't.

If that goes balls-up, I'll request a refund. :rolleyes:

Could come back to bite you on the ass. Buying from someone who hasn't title to sell is open to challenge later. Be careful.
 
Quite simply, if I don't get a reply tomorrow, I'm asking for a refund because clearly they did not legally own the domain so they couldn't sell it.

I wish Nominet would just bring in EPP.
 
Right, I've asked for a refund. Luckily the amount I paid for the name was small, it only had a fortnight left on the registration. Still, I would like my money back ofcourse :)
 
If you have any problems, just hint that you will report him to the authorities as selling something you do not have authority to sell is fraud.
 
I got a "refund". I pushed the domain back to the guy and I got the money back in Paypal, but the guy didn't Refund me, he just sent the money to me so I'm down ~50p. Luckilly, as I said, it was a small amount to pay so, Meh! :p
