This is the sequence of events with my assertion:-

I wrote: 09/02/2006 10:05:41:

I will ask you a few questions over the next few days
regarding the Policy, Procedure, Process. One of the reasons I need to
ask such questions is to determine whether I should cancel any of my existing
domain names.

Question 1

What is the definition of a 'Generic Domain Name'(a termed referred to by
Nominet's expert and/or experts)?

Lee,

This is one I answered very recently on acorn - best have a look there
rather than me repeat it here.
(It's in the 'Domain Research' section, as a response to the post
'generics'.

who is or what is and where is Acorn?

Acorn Domains, a domainer's forum.
http://www.acorndomains.co.uk

So my assertion is this: On the balance of probability did Nominet think I was a member of Acorn prior to the email dated 9/2/2006?

What does it matter what we think?

Plus the above has been covered in another thread?! (with the result being it was either seen as a genuine mistake or a wider conspiracy)

why does it matter

I will tell you why it matters:- I was directed to a forum that lists domain names that resemble trade marks with a caveat that says....register TM domain names at your own risk.

Nominet should remain impartial such a recommendation is unprofessional.

If I am incorrect with my assertion then take me to court Nominet....with the recommendation to acorn you, Nominet are no longer impartial...you, Nominet, favoured a certain resource.

Who are you talking to ?!? I am not nominet.

If several of us post 'who cares' or 'nominet were wrong' or 'the sun shines out of nominets arse' how on earth does it matter either way.

If you want Nominet try http://www.nominet.org.uk/about/contact/ which lists post, email and phone numbers.

Nominet should remain impartial such a recommendation is unprofessional.

Nominet states in Clause 7.4, 7.5 and 7.6 of the Terms and Conditions that: "by registering or using the domain name in any way, you will not infringe the intellectual property rights (for example, trademarks) of anyone else;" and "you are entitled to register the domain name" and "you have not registered the domain name in a way that fails to meet with any legal duty you have".

Whilst I understand you think the Terms and Conditions are hard to understand, I would invite you to accept that the above clauses are written in understandable English. Hence, in my opinion, Nominet is impartial and tells people exactly what you say Acorn Domains ("a forum") tells them; that you "register TM domain names at your own risk".

If a recommendation is made in good faith it cannot be unprofessional. You say Michael Penman of Nominet was not helpful, Michael says he was trying to help. He also says he thought you were already a member of Acorn Domains. I believe him. Other people must make their own minds up.

Agreed, a bit of research in the right places saves everyone time. The information is there on Nominet's site if your willing to look.

There's too many knee jerk comments and new threads of late, where the majority could be avoided, and most end up in us either giving you the same answer of redirecting you to a page on the Nominet site.

I don't understand the need for sarcasm Lee. You made a bold statement that Nominet was not impartial. I was simply pointing out factual evidence to the contrary in that Nominet already gives easy to understand impartial advice in their Terms and Conditions.

On the 24/1/2006 10.29am DRS03078 was posted by Nominet on AcornDomains.co.uk . This post was made even though Nominet were aware that the domain name in question was subject to Appeal.

Such action was not asked for or required as part of the Nominet Policy. Under the Policy DRS decisions are made public via the Nominet website. The Policy does not allow for favourtism of posting the decision on acorndomains.co.uk.

You have a very strange interpretation of "favouritism".

and why

and why have nominet never paid any compensation for a decision thru the DRS even though jac has noted that he doesnt think all the drs decisions are how they should be

Would you give money to GHD?

Imagine

Imagine a man goes to the Council of Mortgage Lenders (CML) and says:-

Can you tell about Buy To Let with no money down....

CML say: not going to answer that but go here...they have a property buying club and a forum http://www.landlordtrader.co.uk/syndicate.html

What would the FSA do?
