Wayback machine Rebuilds

I have several hundred of these sites with content most from wayback, some I put a new site up after a while, I have never had a complaint re copyright and I do very well from it, a few sites get over 100k uniques a day :), wayback is also a mine for other content, I have a travel blog which has over 22k very will written articles which I place onto different sites.:):):)

That's interesting although I'd be careful of broadcasting your game that's going to attract a copy-cat element.

No, it doesn't give someone a legitimate right. But, it's going to happen and, personally, I have bigger issues to get worked up about.

At the end of the day, if someone doesn't want their content stolen then it's up to them to police this - just as if the original site was still live.

Maybe registrars should warn people that dropping a domain doesn't erase all history of any site it was pointing to, which is what some people seem to believe?
 
Here is a classic example this site dropped and somebody bought it on UKBO and reinstated the content from wayback, it was a great site and it would have been a shame for the content to disappear.. http://www.whoviannet.co.uk/

It does not matter how you quantify it. Using someone elses content without permission to do so is still piracy.

Unless someone can prove me wrong ?

Definitely copyright infringment. John Lennon is dead.... but if you tried to pass of one of his songs as your own you'd last about three minutes before you had the estate on your back. Same thing, just not policed in same way.
 
I think of this similar to a 'physical world' situation, e.g:

I buy the house at No. 5 Any Street. The house has been emptied of all belongings and I move my own stuff in. I also have the good fortune of retaining and transferring the existing landline telephone number to me for the house - 01234 567890.

I notice on Google Maps that my new house used to have a builders sign up outside advertising an extremely successful/profitable business that's now been discontinued (retired/bankrupt/changed name - take your pick, etc). Also displayed on the sign was a useful little DIY building article (I'm told it was very popular by my new neighbours) and the house's tel. number 01234 567890.

I decide to start-up as a sole trader builder, so I recreate the previous sign (exactly, same font, same text, everything...) and place it on my driveway, in the exact same location the previous sign was displayed - I do not ask the previous business/company for their permission and I do not tell them what I've done. I now profit and directly take lots of business/traffic/enquiries etc from the new sign, even though I'm passing my business off based on someone else's past success/presence/history etc.

The above is wrong for many reasons.

Or, am I looking at this too simplistically and the analogy is not valid? :)

We were looking to pick this up for a client but now its already been pre-outed on Acorn before its even been used for anything we're going to leave it.

I'm sure Darren Cunningham will be delighted you're wrecking his sales before they've even happened.

Because now you're all looking at it to see what it was going to be used for. Good domains will come up monthly so any with unwanted attention can just be passed over and we'll wait on another one.

Maybe we're being over cautious but after watching Acorn out helptobuy and costing someone £40k I think its probably sensible to be more cautious.

Clearly re-use of them is not within Google's rules so its all about managing risk/reward.

If you guys keep outing domains for some giggles, don't be surprised when you run out of buyers for them.

Keep digging. First you're making it more difficult for Acorn members to sell their catches, now you're calling the end customers thick?

Do you think thats a positive for Acorn members overall, or a negative? Perhaps acorn member Darren will now "give a shit" given it was his domain we're now not going to buy?
 
I'd prefer to be cautious after watching someone become a £40k bag holder with helptobuy.

Maybe I'm being overly cautious but its my budget to spend and my choice.
 
The person buying it knew there was a large risk buying it.

Absolutely, but the risk was increased when domainers tried to get it as much publicity as they could. There was no need for that.
