Update on Fasthosts/Nominet domain transfers

    I can't post in the thread I had fully explained in as I have now started legal action for Libel.

    Admin was informed but the thread is still visible and happy to refuse my request, which was perfectly lawful.

    No matter what snippets from several contributors have said, I have stated the facts below.

    FACT

    It was in Fasthosts terms to take over these domains.

    FACT

    The registrants did not own the domains as you all know no one can own a domain, however they were the legal registrant who had let the domain go past expiry, the email address on file was emailed by nominet several times and it would have been the email of the co.uk owner and not a fasthosts one, including 7 days before deletion as the domains were not marked no longer required.

    Nominet were fully aware of these terms and happy for them to be practiced prior to their uturn.

    Many people asked prior to transferring these domains whether it was ok to do so, stating that they were not the owner and wanted to renew and take over ownership, Fasthosts agreed this was ok and their terms backed this up.

    I did not have a fasthosts account prior to posting my concerns, I then when challenged participated and published here on acorn the journey and process.

    The exercise was not carried out by the registrar I manage.

    No one from Fasthosts or Nominet has contacted me in regards to this. Fasthosts refunded my payments and Nominet without notification to the registrant or the registrar, not one in the same legally took the domains from them and released back to fasthosts.

    The reality is this must have been going on for some time and not just at fasthosts, not all last minute renewals are suspect, but during this last few days, people have just concentrated on the fasthosts domains, when domains like englishtutor.co.uk may have been renewed on the drop day and its not mentioned, why just the focus on fasthosts and .uk and not all uk domains? I am not saying there was anything wrong with the englishtutor domain in any way ,just using it as an example.

    People in the thread who had attempted to complete this process only to find they had been beaten to it by the rush soon started to be hypocrites in condemning the others.

    The furore about this will mark the end of domain catching, it was teetering as it was, but entitled catchers have more than likely driven the last nail in.

    There are a lot of domain catchers nowadays, but guess what, there are many multiples more each year who wake up one day and realise that their domains have gone and they now have to buy them back or start a drs for them. Nominet have been dealing with these people and pacifying them for years so only very few ever reach our doors, they are unlikely to bother going forward.

    Fact, you took control of the names without the owners permission and removed them from their control. You also failed to return them when it became apparent that you didn't have their consent. You admitted that you did this, the very definition of theft.

    Fact you have been editing and deleting your posts all the way through this, screenshots were taken of the original content.

    Fact - The rest is just waffle and a smokescreen

    For this term to be legally enforceable, there has to be a period between domain suspension and domain deletion. reason been, a registrant can renew domains till deletion time. Legally, this terms cannot be enforced for this reason.

    I sometimes chose not to renew domains and late hour renew them because they have not dropped, if my domains were moved to another registrant and renewed not delete and renewed, there will be an issue even though I was not sure I want to keep the domain in the first place.

    To enforce this term, there has to be a period between suspension and deletion, where registrant cannot renew the domain unless they contact the registrar.

    None of us here will be happy if we loose a domain through this process and this terms challenge in a court will not stand because there is no change in the registrant actions to renewal action between the period of expiry and deletion/renewal action.

    How are you going to try and prosecute someone for libel? I doubt anything anybody has said here is untrue. Fasthosts were in the wrong, but as the saying goes "it takes two to tango". By that, I mean you had to play your role too. Fasthosts didn't just hand it over to you without you asking them for it. Knowing fine well, that this domain name wasn't publicly available yet. That, my friend, is theft by misrepresentation.

    Guess its all down to an opinion of how the terms could be applied, people trusted that fasthosts had complied with their terms and gained permission, it wasn't for the new registrants to gain it, I know categorically that I did not break the law and steal and can prove so, I look forward to you proving me wrong and not just giving your opinion.

    Only post that was deleted was the first reveal of the flaw, no posts have been edited and if one was for a spelling, there was no change to the post message, I also have every post and and every revision made by people from the thread.

    On a serious note, who do you represent, all I see since you came to the forum is post replies to two users called Ben and likes to virtually every post by users called Ben.

    I can say that I am more than happy with nominet and less than happy with fasthosts, not that either will sleep worse or better for that knowledge.

    So are you saying you don't agree with people saying you stole them, but you agree that you knew you were trying to obtain access to domains you knew you shouldn't have?

    You're just saying it should be allowed because there were loopholes in place that allowed you to take them?

    If you have read my full open and transparent step by step account on the thread you will know that I was flagging up a practice that was not illegal but had issues. If I had intended to obtain any to keep, i would have registered the ones i was polling for and kept my mouth shut. I can not speak for everyone else involved, just myself.

    Now going into old thread content so end of my posts here.

    I guess my only issue is that what you say doesn't align with your actions.

    Appreciate you keep stating it wasn't your 'intent' to steal in the other thread. Merely to prove it was happening/possible or some odd reason. But decided to do that with 10 domains, not just 1.

    The thing for me, is that if you honestly believed it wasn't dishonest, stealing or whatever, you would have carried on registering more. I mean, why wouldn't you? Why did you stop registering valuable domains, for very little money, if you believed it was above board.

    That to me doesn't make sense.

    You renewed them, you transferred them into your name and took them onto your tag away from the owner - 10 times on 10 different names. Then you didn't give them back.

    This is beyond silly

    I did this all in the open and did so to flag it up, which it now has. pita dealing with phantom posters and the fallout on here,but I would do it all again if i had to.

    So ben or Michael, whoever you are, why not start a few conversations about domains and not just comment and like other peoples as you aint fooling anybody with your nonsense.

    Can you answer why you decided to test the process 10 times, rather than once or twice?

    I can appreciate testing the system out twice. Once to show it works and then another to be 100% sure it wasn't just a fluke or something... but 10 times?

    Can you also clarify why you didn't return the domains straight away, if your intent wasn't to keep them?

    I posted openly about what I was doing and kept everyone up to date, so yes always with the best intentions. Don't judge others by your own standards.
