123-Reg Cock up?

Hi all, i registered a domain with the above on 9 May and was emailed an invoice by them a couple of hours later. However in whois my registration never appeared. I contacted them via there my support but didn't receive an answer, also tried phoning but just put on hold for 10 mins so gave up. Now whois has someone else as the registrar with a registration date of 11 May.

Is there anything i can do about this or have 123 stuffed up? Or is it due to some other reason?

Just an update on this. Finally got through to 123, they were pretty useless and the woman I spoke to said she would pass the issue onto her manager who would phone me on Monday, as of today (wednesday) I am still waiting on that phone call.

The domain name continues to sit in my 123 control panel despite the fact that someone else has now registered it.

Well hacked of about this, I had got wind of a start up backed by a large merchant bank that intended to use the name (and had raised a few million for the business) - so would have been worth a few bob. Needless to say it was the start up that registered it two days after I had originally.

Umm, VERY annoying. Should have used a second Registrar as a backup and checked the Nom database much sooner.

I am a newbie to domains generally, so excuse my ignorance if this is an obvious question.

But would I have a legal case against 123? My thinking is that they have invoiced me, shown the domain in my cpanel and failed to follow up my query re the non registration of 10 May (name was ultimatley registered on 11 May).

So they have failed to deliver somehting they have invoiced for, given the impression it was all processed (via cpanel) (mislead?) and failed to rectify the original non registration (negligence?). (Its still in my 123 cpanel!)

So if it could be shown that the start up would have been prepared to pay £xx,xxx to acquire the domain could that be claimed against 123? Or are there T&Cs as tight as nats backside so that it doesn't matter how badly they cock up you will only get their original fee back?

If you have the cash to burn why not get a solicitor involved, but if you lose then you're out of pocket. What started as a money maker becomes a money loser. Get your source to feed you inside info on other future startup ventures, pm me, I'll register the domains in seconds, and we'll split the loot.
 
Do Pipex still own 123-reg? If so if you pm me nicely i may give you some directors email addresses. I ended up doing that and 123-reg phoned me!

Isn't that called "cybersquatting".
 
In future, use ukreg.com or heartinternet.co.uk to reg your names as registration is almost instantaneous.

You apply and 10 seconds later you have an email confirmation and your name is on the whois.

As Stender says Heart always register instantly... I would leave 123 as soon as possible, although there are a few here that like their service I have found them to be a complete nightmare!

I think you will find that your payment (and invoice) for £6 or however much it was, only obliges them to try and register a domain for you. If they are unsuccessful for any reason then you can request a refund. This applies to all Regsitrars, not just 123-Reg.

It is annoying, but best bet is to forget it and move on.
 
Thanks everyone for the advice. I have calmed down now (well slightly) and will use it as a lesson learned.

But I would like 123 to come back to me given to date they have ignored my email re the non registration so Sender I will be sending you a nice pm just now!

It's been over 2 months since I tried registering 3 or 4 domains with 123 reg and they still haven't done it even after a few emails about it. Also I asked for it just to be refunded - This also hasn't happened.
