Advice needed on CompanyNameKeyword.co.uk

Hi All,

I am after some advice on what direction/what chances I have at getting a domain.

My company has been registered since 2003 and 2008 we changed our name to our current name. However we registered our name in 2007 and have been trading since then (we just didn’t update our company name until 2008 ).

We have just noticed a company trading in another area a few hundred miles away from us. They have registered OurRegisteredCompayNameKeyword.co.uk.

They registered this around 12months ago. I consider this a real problem to our brand name and people may search for our name with the keyword (they are in the same trade).

Not sure if it matters but the site states their real ltd company name which has been registered since 2003 and has another .co.uk, so it sounds to me just to be a keyword grabbing site.

Just really require thoughts on how to proceed and what chances we have of getting the name off the net. They also have the .com.

Can you tell us your company name and the web address the other company are using.

If your company name is unique to you. For example. Trueman designer ltd

And they are using a domain. Trueman designer kitchens. Then totally illegal where no consent or agent agreement in place. Easy to win passing off case.

I'm guessing it's more open than this though so do tell.

I can't see how you can be upset by this but, I would advise it really would come down to how unique your Company name is. There are many good and valued counter arguments to justify holding a descriptive term if for instance.

Is the registrant Not blatantly trying to pass-off - but actually benefiting from the Country wide traffic/association with the term.

Do you have other instances of the same behaviour - by the same registrant in respect to other competitors.

The trouble with giving advice in these type of scenarios is that it's quite rare to get anything other than the "objectors" point of view. So without disclosing the whole picture nobody is in a position to tell you anything
