.com's going after .uk (DRS)

Have you seen these recent cases:

http://www.cowshedonline.com went after http://www.cowshedonline.co.uk which seems to be parked with Namedrive and won a Summary Decision:
http://www.nominet.org.uk/disputes/drs/decisions/decisionssearch/?disputeid=8782

http://www.physioroom.com went after http://www.physioroom.co.uk which is also parked with Namedrive and won because the respondent is in the three cases table (Summary Decision again):
http://www.nominet.org.uk/disputes/drs/decisions/decisionssearch/?disputeid=8676
 
Nothing really new about tld’s going after the cctld’s or vice versa if you only park a domain and it’s registered after the .com etc then it’s easy for them to make a case. If you’re just sitting on it doing nothing then you’ll more than likely lose, People might whinge about it but it’s easy to stop by putting up a site…?
 
Its an absolute disgrace that Complaints aren't vetted by Nominet for validity.

Their are no word marks for any of those cases in a keyword context at the IPO

Nominet should have rejected them as invalid.
 
The issue with Matt Warne should in my view been a small tiny warning about this, he lost one on a summary DRS. Which is a bit of shame in the fact that he had died a few weeks earlier. In the end in my opinion it wasn't a valuable name, so the damage was limited.

I always warned of 2 things, even documented before Matt's death. People will take this up as a new sport, instead of dropcatching. £10 try your luck for a prime generic. Secondly, people PRSS'ing when they hear someone has died.

In my view something needs to be done to stop both of these issues, that's before we even get onto some postman getting a bit careless with a letter and costing someone a few k.

No massive harm has been done yet, but soon as it happens to the wrong person and the wrong name, its going to end up in court and posts like this will be used as evidence that the problem was foreseeable.
