Oh yes, and where did you make this clear in your contract?

thats right....Trading Standards states to me 'appears'

Lee, limits aren't defined in the contract.

Nominet have only defined that when you register a domain name you gain a right to derive the benefit of its undefined USE.

BUT if you take advantage of another's rights the domain name can become abusive.

BUT an expert can't define whats abusive because he/she doesnt know the rights of the registrant.i.e. all Nominet have said is that when you register a domain name you gain a right to derive the benefit of its undefined USE.

It would be all OK IF the experts were considering whats abusive in law BUT they have clearly defined (recently) that they do NOT decide Trade Mark Infringement OR Passing Off they merely follow the policy which includes the contract which includes the right of registration ie. the right to derive the benefit of its undefined USE.

I can't see how Nominet have followed the contract in any instance IF they have relied on the experts decision that is based on the DRS policy.
