Got a bit of a hypothetical question for you lot that I'm just curious about.

If a product is not trademarked in the UK, but is trademarked elsewhere, does the trademark holder have any claim to .uk domains containing the trademark?

So lets say, for example, 'new york knicks' is trademarked in the US but has no trademarks that would cover the UK (eg: UK or international marks) - could someone here safely register newyorknicks.co.uk without any fear of them coming after the domain?

I believe if they own the trademark in the US, and you have a thetrademarkeddomain.co.uk then, yes you are still potentially breeching the TM.

Given you do not have to be a UK resident to register a .co.uk domain name, I believe you would be in risk of breaching their trademark.., unless you can categorically prove the domain name is not associated with the categories that the US trademark has registered against.
