It says it was packed and ready for shipping yesterday at the processed £55 with free delivery so fingers crossed!

STATUS Cancelled

Bit cheeky because they havnt sent me an email or anything, I actualy needed this as my old one is broken so as far as im concerned if I didnt look its turning up next week.

Where do I legaly stand, It said that it had been packed and awaiting shipping....
 
Balls, mine is now showing as cancelled as well! Doesn't say how or why.

Their T&Cs say that the contract isn't formed until they accept the order, so I don't think we've got a leg to stand on :(

Will wait and see though...
 
They have charged my card, the money has come out of my bank.

Surely by processing the payment and setting the status to packed and shipping they have entered the contract and cant go back on it?

They state that in the case of a miss price they will contact you and allow you to either cancel or go ahead by paying the full correct price.

In this case they have charged me and then cancelled at last minute without even contacting me....

This suggests to me that we're fooked :)
 
Legally, once they take the payment, the contract is formed. It just depends whether you want to enforce that!
 
Its just an inconvenience, I really needed this printer for next week and so far have had the item cancelled without any form of contact and im also down £55.

Ill give them a ring tomorrow and see what they have to say for themselves, its certainly not good service and doesnt follow their terms and conditions.
 
I think it's somewhat rude not to email to tell us that the order has been cancelled.

Well i now know where not to shop onlne.

Looks like their luring people in and hoping they would carry on with the order at full price, i wonder what trading standards would say ???

Search on google for other people who have been duped, get a collection of signatures and then send them to the tradng standards insisting on an official ivestigation, it might work ?

You could always mention a small claims court and how little it costs to take someone to a small claims court ?

A invitation to open negotions with a view to forming a Contract. contact your credit card company to see if they will step in to the frame, you might get lucky.......just don't waste too much time on what could be a lost cause.
 
according to keys post mat your in the right imho. You paid so that is the checkout.
 
Keys is a good post. I used to work in retail and we were not obliged to sell if there was a wrong price put on an appliance as it was "human error".

I think you will find play.com clearly state they are not contracted until the goods are dispached because this will be the 1st time there is any human interaction with the sale. I bet you all that goes before is fully automated.

goods priced on site (wrong price, human error)
customer orders goods (automated)
c/card checked and authorised (automated)
goods readied for despatch and order checked (1st human contact and error noticed)

Order cancelled and pricing error rectified.
