1) p90x is a trademark.
2) [p90x workouts] gets 36 exact UK searches a month, not 368,000.

Google keyword tool shows the term ' p90x workouts ' as having 368,000 global searches

Try changing it from broad to "exact" search and becuase its a Uk domain you say the local not global.

Yeah, right.

So why is it when I do a trademark search I get 6 live UK trademarks for the exact string "P90X" and 8 live US trademarks for the same "P90X"? Also, on the P90X website the P90X logo has a registered trademark symbol next to it...

That's the official trademark registration. I'm not providing any video tapes, cassettes, dvds or cds featuring exercise, fitness and dietary information. And my domain name isn't specified in block letters as the trademark has been registered. There is no legal tie to the beachbody program who own p90x. I'm not that stupid that I didn't take legal advice before acquiring this domain. Just look at all the other p90x websites. They are owened by various different people

Who did you go to for the legal advice?
 
Because the domain is not that valuable IMHO and legal advice doesn't come cheap unless you are a lawyer.
 
To be fair I have been completely honest about the domain and you don't need to make a website about the power 90 extreme workouts to monetize the traffic this domain will get. I'm not trying to trick anyone into buying this.

I guess you didn't see the registration for trade mark number E3240975 then? It's quite clearly registered for the following...

Class 41: Educational services, including dietary and exercise instruction.

If it's not the above, what exactly do you class a "workout" as? Whatever it is, good luck trying to argue that in the courts. ;)

No you are not, but what exactly would you suggest the buyer of this domain do with it? Advertise cars for sale?

This sales thread has shown you are very aware of the existing trademark and its use, probably enough for a DRS in itself.

If you really did get legal advice then either it was incomplete or you are being disingenuous. Any advice that told you it was ok to register this domain would have gone on to tell you it was not ok to use this domain.

If registering and trying to flip TM domains is a new idea of yours, best take some time to read further on Acorn and on Nominet. This thread may be of particular interest, dossier about everything not to do. You may also want to read up about the Adwords keyword tool, exacts, and their relevance to UK domains.

It's not a new idea. As you can see I'm completely new at this and had no idea of problems id be letting myself in for. What would you suggest I do now?

Read (there's a lot of good information here on Acorn), learn, stay away from deliberate TM domains. Domaining is not a get rich scheme, or even a way to make a quick buck. Good luck.

I suggest you delete the domain name. Why wait for a DRS which you'll lose? Then that would become the first of 3 strikes against you, and at 3 strikes you have a whole new world of pain waiting for you based on Nominet's current Dispute Resolution policy...

There shall be a presumption of Abusive Registration if the Complainant proves that the Respondent has been found to have made an Abusive Registration in three (3) or more DRS cases in the two (2) years before the Complaint was filed.
